TERMS AND CONDITIONS

 

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the TAG Poker mobile application and any associated services (together, the "Platform"), operated by Vikven Entertainment Private Limited ("VEPL", "we", "us", "our"). By creating an account or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Platform.

 

2. Eligibility

1. You must be at least 18 years of age to register for or use the Platform. You will be asked to affirmatively declare your age at registration, and access to gameplay is conditional on that declaration.

2. You must have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.

3. You may hold only one account. Creating or controlling multiple accounts, whether personally or through others, is prohibited and may result in suspension or termination under Section 11.

4. You are responsible for ensuring your use of the Platform complies with the law applicable in the state or territory from which you access it.

 

3. Nature of the Platform

TAG Poker is an online social game offered for entertainment, recreation, and skill-development, within the meaning of section 2(1)(i) of the Promotion and Regulation of Online Gaming Act, 2025. It is not, and is not offered as, an online money game. In particular, and without limitation:

Poker chips used at the table ("Chips") have no monetary value, cannot be purchased for money or for T-Diamond, directly or indirectly, and cannot be redeemed, exchanged, or converted into money, T-Diamond, or any other thing of value.

Chips are allocated to you automatically, on a fixed and uniform basis applicable to every player within your club tier, and are session-scoped: your Chip balance resets on the schedule disclosed in the Platform, and no cumulative or lifetime Chip total is tracked, displayed, or rewarded.

No club owner, manager, agent, or any other user has discretion to allocate Chips to you outside the automatic allocation described above.

T-Diamond is a purchasable virtual currency usable solely for VIP passes and cosmetic Store items. T-Diamond has no monetary value, is non-transferable between accounts, cannot be redeemed for cash, and does not convert into Chips.

No feature of the Platform offers a cash prize, a cash-equivalent prize, or any gameplay-linked monetary reward.

You acknowledge that these characteristics are integral to the nature of the Platform, and that any feature request or third-party conduct that would circumvent them (including off-platform settlement of gameplay outcomes, described further at Section 10) is expressly prohibited.

 

4. Account Registration and Security

You must provide accurate and complete registration information and keep it up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You must notify us promptly of any unauthorised use of your account.

We may suspend or terminate an account that provides false registration information, including a false age declaration.

 

5. T-Diamond

T-Diamond may be purchased in-app through our payment gateway partner, in the denominations displayed in the Store.

T-Diamond has no monetary value and is not a financial product, security, or deposit of any kind.

T-Diamond is non-transferable between User accounts by any means, including by customer support intervention, and cannot be pooled, gifted, or merged on account consolidation.

Unused T-Diamond is non-refundable except where required by applicable consumer-protection law or store policy, or where expressly stated in our Refund and Cancellation Policy.

Promotional or bonus T-Diamond, where issued, is subject to the same restrictions as purchased T-Diamond.

 

6. Chips

Chips are issued to you free of charge, automatically, on the fixed and uniform basis described at Section 3.

Chips cannot be purchased, directly or indirectly, by any means.

Chips cannot be transferred between User accounts, gifted, sold, or otherwise moved to another User by any means.

Chips cannot be converted into T-Diamond, cash, or anything of economic value.

Your Chip balance is session-scoped and will reset as disclosed in the Platform. No feature of the Platform treats accumulated Chips won as a persistent or displayed asset.

 

7. VIP Passes and Subscriptions

VIP passes are offered in the tiers and durations displayed in the Store, billed through the Google Play Store or Apple App Store as applicable.

Where a VIP pass auto-renews, this will be clearly disclosed before purchase, and you may cancel auto-renewal at any time through your app-store account settings, consistent with Google Play and Apple App Store subscription policies.

VIP pass benefits are confined to non-Chip benefits — cosmetic items, customisation options, and platform features — and do not include any variation in Chip allocation by tier.

Refunds for VIP passes are governed by our Refund and Cancellation Policy and by the refund policies of the Google Play Store or Apple App Store, as applicable to your purchase.

 

8. Store, Cosmetic Items and Customisation

Cosmetic items purchased with T-Diamond — avatars, accessories, emotes, and table themes — are non-functional and confer no gameplay advantage of any kind, including no advantage in turn order, visibility of concealed information, time-bank duration, or table or seat selection priority, and no access to competitive play beyond what your VIP tier already grants. Cosmetic items cannot be transferred, gifted, resold, or otherwise moved to another User, and cannot be redeemed or converted into Chips, T-Diamond, or cash.

 

9. Clubs

9.1 Creating and joining a club

You may create a club, subject to the age declaration at club creation and these Terms, or join an existing club using an invitation or club identifier. Club membership is free.

9.2 Club roles

Clubs operate with the following roles, each subject to the permissions and restrictions the Platform assigns to it: Member, Manager, Agent, Super Agent, and Owner. No role, including Owner, has discretion to allocate Chips outside the automatic mechanism described at Section 6. Any compensation, ranking, or visibility associated with the Agent or Super Agent role is calculated without reference to the gameplay volume, wins, losses, or Chip activity of players in that Agent's downline.

9.3 Prohibited club conduct

The following are strictly prohibited within any club, by any role, and may result in suspension of the club, the individual account, or both:

Any arrangement, express or implied, for off-platform cash or cash-equivalent settlement of gameplay outcomes.

Soliciting, offering, or facilitating the purchase or sale of Chips, T-Diamond, or cosmetic items outside the Platform.

Any commission, referral, or incentive structure that ties a club role's benefit to a member's gameplay activity, wins, or losses.

Using the club Ticket or Voucher features, or any other Platform feature, to settle, transfer, or represent value outside the Platform's own Chip and T-Diamond mechanics.

Every club Owner and Agent is required to accept our Club and Agent Code of Conduct, which contains further, more detailed obligations including audit cooperation and mandatory reporting of suspected violations, before being granted the corresponding role.

 

10. Prohibited Conduct — General

In addition to Section 9.3, you must not:

Use bots, scripts, automation, or any unauthorised software to play on your behalf or to gain an advantage.

Collude with another User to gain an unfair advantage over other players.

Exploit any bug, error, or unintended feature of the Platform, and must report any such issue to us promptly.

Engage in real-money wagering of any kind in connection with your use of the Platform, whether on-platform or off-platform.

Harass, threaten, or abuse other Users or VEPL staff.

Use the Platform for money laundering, terrorist financing, or any other unlawful purpose.

 

11. Enforcement, Suspension and Termination

We may investigate, suspend, or terminate an account, with or without notice, where we reasonably believe these Terms have been violated, including the prohibitions at Sections 9.3 and 10. Our Fair Play and Anti-Cheating Policy describes the monitoring measures we use, including pattern-based detection of anomalies such as unusual churn, complaint clustering, or activity ratios inconsistent with genuine play. We may also suspend an account pending investigation of a credible complaint, without first being required to prove the underlying violation.

 

12. Responsible Play

We encourage mindful and balanced use of the Platform. Tools to manage your play — including session reminders and, where you request it, self-exclusion for a defined period — are described in our Responsible Play Policy. If you believe your use of the Platform, or that of someone you know, has become a cause for concern, please contact us using the details in Section 17.

 

13. Intellectual Property and User Content

All intellectual property in the Platform, including the TAG Poker name, logo, software, and design, belongs to VEPL or its licensors. You retain ownership of any profile content you upload (such as a profile photo), and grant us a limited licence to use it solely to operate and display that content within the Platform. You must not upload content that is unlawful, infringing, or otherwise objectionable, and we may remove such content and take enforcement action under Section 11.

 

14. Disclaimers

The Platform is provided "as is" and "as available." We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components, and disclaim all warranties, express or implied, to the maximum extent permitted by applicable law.

 

15. Limitation of Liability

To the maximum extent permitted by applicable law, VEPL's aggregate liability arising out of or relating to your use of the Platform is limited to the amount, if any, you have paid to VEPL in the three months preceding the claim. VEPL is not liable for indirect, incidental, or consequential loss, or for any loss arising from conduct of another User, including conduct prohibited under Sections 9 and 10.

 

16. Indemnification

You agree to indemnify and hold VEPL harmless from any claim, loss, or expense arising from your breach of these Terms or your violation of applicable law.

 

17. Grievance Officer

Consistent with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, grievances regarding these Terms or your use of the Platform may be addressed to:

We will acknowledge your grievance within 24 hours and endeavour to resolve it within 15 days.

 

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms shall first be addressed through good-faith negotiation, failing which it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, seated in Bengaluru, Karnataka, conducted in English, by a sole arbitrator appointed by mutual agreement. Subject to the foregoing, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction.

 

19. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the Platform before they take effect. Continued use of the Platform after a change takes effect constitutes acceptance of the revised Terms.

 

20. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force.

You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.

These Terms, together with our Privacy Policy and any policy referenced in them, constitute the entire agreement between you and VEPL regarding the Platform.
